5. These terms and conditions do not exclude Marsland Aviations' liability (if any) to you for personal injury or death resulting from Marsland Aviations' negligence, for fraud or for any matter which it would be illegal for Marsland Aviation to exclude or to attempt to exclude its liability.

Modifications To Terms

These terms and conditions and/or other information provided on this website may be updated, amended, changed or removed by Marsland Aviation at anytime and without further notice to you. You should re-read these terms and conditions every time you visit the website and ensure that you review all the relevant documents each time you use this website. By using this website you agree to be bound by the latest version of such documents.

Carriage Conditions

Conditions of Contract

1. Definitions:

As used in this Contract:

   - “ ticket” means the passenger ticket and baggage check.

   - “carriage” is equivalent to transportation.

   - “carrier” means Marsland Aviation.

2. Applications:

2.1 As of this Contract carriage here under subject to the rules and related regulations which are made part of this Contract, and to the Sudanese Law.

2.2 To the extent not in conflict with fore going carriage and other services performed by the carrier are subject to :

   - a. provisions contained in this ticket.

   - b. applicable tariffs.

   - c. Carrier’s conditions of carriage and related regulations which are made part hereof.

3. Exclusion:

Any exclusion or limitation of liability of carrier shall apply to and for the benefit of agents, servants and representatives of carrier and any person and its agents, servants and representatives.

4. Ticket validity:

This ticket is good for carriage for one year from date of issue except as otherwise specified and can be used only in Sudan.

5. Carriage Tariffs:

The fare for carriage here under is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not been paid.

6. Baggage:

Checked baggage will be delivered to the bearer of the baggage check. In case of damage to baggage complaint must be made in writing to carrier forthwith after discovery of damage and at the latest within fifteen days from receipt.

7. Timing:

Carrier under takes to use best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in time tables or elsewhere are not guaranteed and form no part of this contract, and are subject to change without prior notification.

8. Compensation:

In case of death the limit of liability is governed by Islamic Law and is inclusive of legal fees and costs.

This liability up to such limit shall not depend on negligence on the part of the carrier.

Liability for baggage loss, delay or damage is limited to 16 SDG per kilo or its actual value whichever is less. Additional protection can usually obtained by purchasing insurance from a private company.

9. No agent, servant or representative of carrier has authority to alter, modify or waive any provision of this contract.

10. The ticket fare is subject to change before transportation.

11. Cabin baggage remains the passenger own responsibility.

NOTICE OF government imposed taxes, fee and charges

The price of this ticket may include taxes, fee and charges which are imposed on air transportation by government authorities. These taxes fees and charges which may represent a significant portion of the cost of air travel are either included in the fare of shown separately in the “ tax/fee/charge” box(es) of this ticket you may also be required to pay taxes fees and charges not already collected.

Refunds

This ticket has refundable value only when submitted within one year after the expiry date.

Reconfirmation

If you break your journey for more than 72 hours at any point, please reconfirm your intention of using your continuing or return reservation. To do so please inform the airline office at the point where you intend to resume your journey at least 72 hours before departure of your flight. Failure to reconfirm will result in the cancellation of your reservations (s) if your journey is wholly within Europe, the cancellation rule is not applicable.

Notice to domestic passengers

Carriage exclusively performed within Marsland is subject of the provision of the commercial code of Marsland which limits the liability of the carrier for death or badly injure, and for loss of or damage to baggage.
